Agreement to Terms
By accessing or using the VitaLink mobile application (“App”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the App.
Use of the App
- You must be at least 18 years old to use VitaLink as an agent. Clients under 18 must have a parent/guardian’s consent.
- You agree to use the App only for lawful purposes and in compliance with HIPAA, SOA, and other applicable regulations.
- You are responsible for maintaining the confidentiality of your account credentials.
Nature of the Service
VitaLink is a data storage and sharing tool only. The App does not verify, validate, or guarantee the accuracy, completeness, or timeliness of any information stored or transmitted.
Medical Disclaimer
VitaLink is not a medical provider, insurer, or licensed advisory service. The App does not provide medical advice, diagnosis, or treatment. Always consult licensed healthcare providers for medical decisions.
Emergency Disclaimer
VitaLink is not an emergency service. Information may be incomplete, outdated, or unavailable. In an emergency, call 911 or your local emergency services immediately.
Data & Privacy
Our use of your information is governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described there.
Agent Subscriptions
Agents may be required to maintain an active subscription to access certain features of the App. Subscriptions are billed through Google Play and subject to their terms.
Client Access
Clients may receive access through an activation code or purchase. Certain features may require connection to a licensed agent.
Prohibited Conduct
- Attempting to reverse-engineer, hack, or disrupt the App.
- Sharing unauthorized health or insurance data without consent.
- Using VitaLink for unlawful or misleading purposes.
Service Availability
VitaLink does not guarantee uninterrupted or error-free operation. The App may be unavailable due to maintenance, technical issues, or circumstances beyond our control.
Limitation of Liability
To the maximum extent permitted by law, VitaLink and ET Naturals shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the App, including but not limited to loss of data, errors in information, or reliance on the App.
Indemnification
You agree to indemnify and hold harmless VitaLink, ET Naturals, and its affiliates from any claims, damages, liabilities, or expenses arising from your use of the App, your violation of these Terms, or your misuse of data within the App.
Termination
We may suspend or terminate your account at any time if you violate these Terms or misuse the App.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to conflict of law principles.
Changes to Terms
We may update these Terms from time to time. Continued use of the App constitutes acceptance of the updated Terms.
